Seawall insurance in the Keys.
Assume the wall is yours to fix.

By Lower Keys SeawallUpdated

Seawall insurance in the Keys is mostly a story of exclusions. Flood policies leave the wall out, and recent FEMA aid went to public waterfronts. Here is what still matters for your house, your claim and your association.

Does insurance cover a seawall in the Keys?

Flood insurance does not cover the wall. The Federal flood policy (Dwelling Form) lists seawalls, bulkheads, retaining walls and docks as property not insured. Land and lawns are excluded too. Federal flood policy (Dwelling Form)

There is one narrow exception. FEMA says coverage may exist for a wall that directly supports and is integral to the insured building's foundation. FEMA flood policy commentary, 2025 The June 2025 claims manual keeps the same rule. NFIP Claims Manual, June 2025

Other policies depend on their wording. Ask your insurer for a written answer before you need one.

CRS discounts: your community's flood rating

The wall is excluded, but the house behind it still needs flood coverage. Your community's Community Rating System class sets a discount on most NFIP premiums.

Citizens policyholders: flood coverage becomes mandatory

From January 1, 2027, every Citizens personal residential policy with wind coverage must carry flood insurance. In a special flood hazard area, the rule already applies at any dwelling value. Citizens flood requirement

  • Exempt: condo unit-owner, tenant contents and policies that exclude wind.
  • Flood limits must at least equal the Citizens dwelling value, or the NFIP maximum of $250,000 if that is lower.
  • A Citizens wind-only policy can be backed by a qualifying flood endorsement on the underlying policy. Citizens flood requirement

None of this covers the seawall. It protects the house, which is what a failed wall puts at risk.

Homeowners and wind policies: read the form

A homeowners policy is subject to its exclusions, and flood is generally separate. An open-peril label does not mean your wall is covered. Florida OIR homeowners page

When a storm brings both wind and water damage, notify both insurers. Adjusters split the damage by cause. DFS post-storm Q&A

  • Is the seawall or dock listed anywhere in the policy, and under which coverage?
  • Which exclusions apply to it: water, earth movement, wear and tear?
  • Is there a separate deductible for hurricane damage?
  • Does an endorsement for docks or seawalls exist, and what does it cost?

Get every answer in writing, from the insurer, not only the agent.

Condo and HOA owners: who pays for the wall

Condo associations face a hard date: no structural integrity reserve study may be completed after December 31, 2026. The study applies to buildings three or more habitable stories tall. Section 718.112(2)(g)

  • The study must include any other item costing more than $25,675 in 2026 to maintain or replace, if its failure would harm the listed building systems. Whether a seawall qualifies is for the association's engineer. DBPR condo FAQ
  • The association's NFIP policy excludes seawalls. Federal condo flood policy
  • Your unit-owner loss-assessment coverage pays only for a type of loss your policy covers, up to its limit. Section 627.714
  • At turnover, the developer's sealed inspection report must address seawalls. Section 718.301
  • A condo meeting on a special assessment needs 14 days' posted notice stating its cost and purpose. Chapter 718
  • An HOA that does not fully fund reserves must warn owners this may result in special assessments. Section 720.303

Ask the board for the current insurance policies; they are official records. Section 718.111 See the condo and HOA guides.

Build the claim file now

  • Dated photos and video of the whole wall, taken now and again each spring.
  • After a storm, photos and video before any cleanup, then close-ups. NFIP damage guidance
  • Samples of damaged material, kept only where it is safe.
  • Before-and-after photos and receipts for any emergency work. DFS disaster guide
  • The wall's permits, survey and any engineer's reports.
  • Every insurer letter and claim number, in one folder.

A good file does not create coverage. It does speed up a claim on the house and settles arguments about what the storm caused.

  • Ask for the seller's flood disclosure, given at or before contract. It covers flood damage, flood claims and FEMA aid during the seller's ownership. Section 689.302
  • The Florida Realtors seller disclosure form asks whether the seawall and dock are structurally sound. Seller disclosure duty
  • Home inspectors are not required to inspect seawalls, docks or lifts. Rule 61-30.810
  • Key Colony Beach advises buyers to have a Florida-registered engineer inspect the seawall before purchase. KCB Seawall Owner's Manual
